How the Conservatives made ugly to be hetero and beautiful to be homo - episode 2: the decriminalization of homosexuality in India and notes about heterosexuality (and good wishes to Jair Bolsonaro)

On the same day, September 6, 2018, Jair Bolsonaro was stabbed during a meeting with voters in his presidential campaign in Brazil[01] (and he is called homophobic by his opponents) and the Indian Supreme Court decriminalized homosexuality there. In the Trend Topics of Twitter in Brazil, they were "One stabbed Bolsonaro", "India" and "Bozo", that is a pejorative reference to Jair Bolsonaro. The tweets that quoted the two cases, many were abhorrent. For example[02]:

But I did not say in the title that "Conservatives made ugly to be hetero and beautiful to be homo" because of Brazilian Christian politicians. It is a good thing that LGBT activists in Brazil are so atypical and crazy, and I do not say this in relation to average Brazilians, but in relation to average Brazilian homosexuals. They know they have no essential worries that Brazilian heterosexual do not have. They know that if Brazil is the country with the most murders of homosexuals in the world, and because they are what they are, the world is almost perfect at least for them. This celebration, therefore, is of abnormal criminals who support the homicide of those against whom they fight, it is not of the homosexuals of the real Brazilian people, except when they make theirs the joy of the homosexuals of the real Indian people. The point here is that the conservatives in India also tried to make it ugly to be a heterosexual man and ended up making it beautiful to be a homosexual person.

Let's start with the description of "Moment" by Twitter Brasil[03] (the one by English correspondent is a bit too short):

By a unanimous decision, the country's Supreme Court overturned a law of 1861 that punished acts "against nature" and penalized up to 10 years in prison same-sex relationships. That law had already been overturned by a New Delhi court, but the ruling was reversed in 2013 by the Supreme Court itself, which defined that the ruling would be by parliament. As the legislature did not reach agreement, the Indian government once again asked the Supreme Court to pronounce.

Thus, I went to do a quick search on what is, legally, being a straight man in India.

1) Prostitution in India is not illegal, but it is illegal to maintain or manage a brothel, a hotel to allow prostitution, and even to offer or to solicit the service within 200 yards from a public place.[04]

2) There is already a campaign in India entitled "Cool Men Don't Buy Sex", by Apne Aap, a women's network which says it's fighting to "end sex trafficking"[05]. But as I used to say, prohibiting prostitution to end sex trafficking is like outlawing marriage to end domestic violence. And they say that "without demand for purchased sex, traffickers, pimps, and brothel owners would be driven out of business"[06].

3) Sale, circulation, import, export, advertisement, etc. of obscene material gives at least 2 years imprisonment plus fine (section 292 of Indian Penal Code).[07] Obscene acts and songs give at least 3 months in prison, fine or both (section 294).[08]

4) A man seeing or photographing, hiddenly, a nude woman or a woman in undergarment, or he spreading a photo when she consents to the act but not with the divulgation, this is a crime called Voyeurism, with punishment of at least 1 year in prison (section 354C).[09]

5) The rape in Indian law is true rape, not the clownery that is here in Brazil, that touching a woman on the bus is rape or even the "sextortion" via the internet turning into virtual rape[10]. But there, it also includes the case of a man pretending to be the woman's husband. But likewise in Brazil until about 10 years ago, the Indian Penal Code only foresees rape of woman by man. And the age limit of the presumed rape that in Brazil is 14 years old, is 18 there. Unless when the man and the woman are married and she is at least 15 years old (section 375).[11] Prison for at least 20 years, which may be perpetual or death penalty (section 376).[12] If I had to wait until I was 18, I would go crazy. And all the boys that I would miss the chance to... meet from 14 to 18, and the good moments I gave and received, we would lose. And the most dramatic thing for me would be I wanting to be fucked and the boys afraid to fuck me. But the worst thing is that, in practice, this means prohibitting sexual life not of women, but of men under 18 years old, since it should not be usual a woman to be interested in younger men there, likewise that it is not here. And a teenage man having no expectancy of sexual life is a terrible suffering.

6) Ah, and there is no adulterous woman in Indian law.[13] Section 497 of the Indian Penal Code defines adultery as "sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man".[14] Therefore, adultery has only one person, the man who had sex with the another man's wife. Minimum of 5 years imprisonment, fine or both. The married woman is not framed in anything. Oh really.

Homosexuals in India were freed from imprisonment for at least 10 years plus a fine that could reach life imprisonment, for homosexual sex (not because they were homosexuals, as some idiots in Brazil said).[15] Even I'm happy for the gays there (not for the lesbians, because, as we have seen in Brazil, lesbianism is not sexuality, it is psychopathy). But there, heterosexual men did not have a freedom of sexuality that homosexuals have now gained. For example, sexual harassment can only be committed by men, and a man showing pornography to a woman can give up to three years in jail, fine or both (section 354A).[16]

And look, I thought I was going to mention Apne Aap (of that campaign against clients of prostitution) just in passing, I go back to the page and I see in the sidebar the newest post on their Twitter[17]:

"I am what I am. So take me as I am."- CJI @apneaap welcomes the landmark judgement of the honourable Supreme Court of India striking down the draconian section 377. Moving one more step closer to #equality #nomoreclosets #lovewins

Therefore, is heterosexual sex a crime and homosexual sex a love? Oh, what a surprise!

Le même jour, le 6 septembre 2018, Jair Bolsonaro a été poignardé lors d'une rencontre avec les électeurs lors de sa campagne présidentielle au Brésil[01] (et ses opposants l'appellent homophobe) et la Cour Suprême indienne a décriminalisé l'homosexualité dans ce pays. Dans les «Trend Topics» de Twitter au Brésil, il s'agissait «Quelqu'un a poignardé Bolsonaro», «India» et «Bozo», une référence péjorative à Jair Bolsonaro. Les tweets qui citaient les deux cas, nombreux étaient odieux. Par exemple[02]:

Mais je n'ai pas dit dans le titre que "les conservateurs ont rendu moche être hétéro et beau être homo" à cause des politiciens chrétiens brésiliens. C'est une bonne chose que les activistes LGBT au Brésil soient si atypiques et fous, et je ne dis pas cela par rapport aux brésiliens moyens, mais par rapport aux homosexuels brésiliens moyens. Ils savent qu'ils n'ont pas de soucis essentiels que les hétérosexuels brésiliens n'ont pas. Ils savent que si le Brésil est le pays avec le plus de meurtres d'homosexuels dans le monde, et parce qu'ils sont ce qu'ils sont, le monde est presque parfait pour eux. Cette célébration concerne, donc, des criminels anormaux qui soutiennent l'homicide de ceux contre lesquels eux se battent, ce n'est pas des homosexuels du vrai peuple brésilien, sauf lorsqu'ils font leurs la joie des homosexuels du vrai peuple indien. Le point ici est que les conservateurs en Inde ont également essayé de rendre moche être un homme hétérosexuel et ont fini par rendre beau être une personne homosexuelle.

Commençons par la description de "Moment" par Twitter Brasil[03] (celle du correspondant anglais est un peu trop courte):

L'homosexualité cesse d'être un crime en Inde

Par une décision unanime, la Cour Suprême du pays a annulé une loi de 1861 qui punissait les actes "contre nature" et sanctionnait jusqu'à 10 ans de prison les relations de même sexe. Cette loi avait déjà été annulée par un tribunal de New Delhi, mais la décision a été infirmée en 2013 par la Cour Suprême elle-même, qui a décidé que la décision serait prise par le parlement. Comme le législateur n'ayant pas réussi à se mettre d'accord, le gouvernement indien a de nouveau demandé à la Cour Suprême de se prononcer.

Ainsi, je suis allé faire une recherche rapide sur ce qui est, légalement, être un homme hétérosexuel en Inde.

1) La prostitution en Inde n'est pas illégale, mais est illégal maintenir ou gérer un bordel, un hôtel permettre la prostitution et même offrir ou solliciter le service à moins de 200 mètres d'un lieu public.[04]

2) Il existe déjà une campagne en Inde intitulée «Hommes Cools N'achètent Pas Sexe», par Apne Aap, un réseau de femmes qui se bat pour «mettre fin au trafic sexuel»[05]. Mais comme je le disais, interdire la prostitution pour mettre fin au trafic sexuel est comme interdire le mariage pour mettre fin à la violence domestique. Et elles disent que «sans la demande de sexe acheté, les trafiquants, les proxénètes et les propriétaires de bordels seraient chassés des affaires»[06].

3) La vente, la circulation, l'importation, l'exportation, la publicité, etc. de matériel obscène donne lieu à au moins 2 ans d'emprisonnement et amende (art. 292 du Code Pénal Indien).[07] Les actes et les chansons obscènes donnent au moins 3 mois de prison, amende ou les deux (art. 294).[08]

4) Un homme voyant ou photographiant, en cachette, une femme nue ou en sous-vêtement, ou il propageant une photo quand elle consent à l'acte mais pas avec la divulgation, il s'agit d'un crime appelé Voyeurisme, puni d'au moins un an en prison (art. 354C).[09]

5) Le viol dans la loi indienne est un véritable viol, et non la clownerie qui existe au Brésil, de que toucher une femme dans le bus est un viol ou même une «sextorsion» qui se transforme en viol virtuel[10]. Mais là, aussi il y a le cas d'un homme qui prétend être le mari de la femme. Mais également au Brésil il y a environ dix ans, le Code Pénal Indien ne prévoit le viol de femme par homme. Et la limite d'âge du viol présumé qui est 14 ans au Brésil, là est de 18 ans. À moins que l'homme et la femme soient mariés et qu'elle ait au moins 15 ans (art. 375).[11] Prison pour au moins 20 ans, qui peut être perpétuelle ou la peine de mort (art. 376).[12] Si je devais attendre d'avoir 18 ans, je deviendrais fou. Et tous les garçons qui me manqueraient l'occasion de... rencontrer de 14 à 18 ans, et les bons moments que j'ai donné et reçu, nous perdrions. Et la chose la plus dramatique pour moi serait que je veuille être baisée et les garçons aient peur de me baiser. Mais le pire est que, dans la pratique, cela signifie interdire la vie sexuelle non pas des femmes, mais des hommes de moins de 18 ans, car il ne devrait pas être habituel qu'une femme s'intéresse aux hommes plus jeunes là, également que n'est pas ici. Et un homme adolescent sans attente de vie sexuelle est une souffrance terrible.

6) Ah, et il n'y a pas femme adultère dans la loi indienne.[13] L'article 497 du Code Pénal Indien définit l'adultère comme un «rapport sexuel avec une personne qui est et qu'il sait ou a des raisons de croire d'être l'épouse d'un autre homme».[14] Par conséquent, l'adultère n'a qu'une seule personne, l'homme qui a eu des relations sexuelles avec la femme de l'autre homme. Minimum de 5 ans d'emprisonnement, amende ou les deux. La femme mariée n'est encadrée dans rien. Oh vraiment.

Les homosexuels en Inde ont été libérés de prison pendant au moins 10 ans plus une amende, pouvant aller jusqu'à la réclusion perpétuelle, pour les rapports sexuels homosexuels (pas parce qu'ils étaient homosexuels, comme certains idiots l'ont dit au Brésil).[15] Même moi je suis content pour les gays là-bas (pas pour les lesbiennes, car, comme on l'a vu au Brésil, le lesbianisme n'est pas sexualité, c'est psychopathie). Mais là, les hommes hétérosexuels n'ont pas une liberté de sexualité que les homosexuels ont maintenant acquise. Par exemple, le harcèlement sexuel ne peut être commis par hommes, et un homme qui présente la pornographie à une femme peut avoir jusqu'à trois ans de prison, amende ou aux deux (art. 354A).[16]

Et regardez, je pensais que j'allais mentionner Apne Aap (de cette campagne contre les clients de la prostitution) juste en passant, je retourne à la page et je vois dans la barre latérale le message le plus récent sur leur Twitter[17]:

"Je suis ce que je suis. Alors, prenez-moi comme je suis." - CJI @apneaap se félicite du jugement historique de l'honorable Cour Suprême de l'Inde qui annule l'article draconien 377. Un pas de plus vers #l'égalité #plusdeplacards #l'amourgagne

Par conséquent, le sexe hétérosexuel est-il un crime et le sexe homosexuel est-il amour? Oh, quelle surprise!

Lo stesso giorno, 6 settembre 2018, Jair Bolsonaro è stato pugnalato durante un incontro con elettori nella sua campagna presidenziale in Brasile[01] (e lui è chiamato omofobo dai suoi avversari) e la Corte Suprema indiana ha depenalizzato l'omosessualità lì. Nei Trend Topics di Twitter in Brasile, sono stati "Qualcuno ha pugnalato Bolsonaro", "India" e "Bozo", che è un riferimento peggiorativo a Jair Bolsonaro. I tweet che citavano i due casi, molti erano ripugnanti. Per esempio[02]:

- Bolsonaro è stato accoltellato

- domani è vacanza

Grazie, 6 settembre ????????

Ma non ho detto nel titolo che "i conservatori hanno reso brutto essere etero e bello essere omo" a causa dei politici cristiani brasiliani. È positivo che gli attivisti LGBT in Brasile siano così atipici e pazzi, e non lo dico in relazione ai brasiliani medi, ma in relazione agli omosessuali brasiliani medi. Loro sanno che non hanno preoccupazioni essenziali che gli eterosessuali brasiliani non hanno. Sanno che se il Brasile è il paese con il maggior numero di omicidi d'omosessuali nel mondo, e perché loro sono quello che sono, il mondo è quasi perfetto almeno per loro. Questa celebrazione, quindi, è di criminali anormali che sostengono l'omicidio di coloro contro cui combattono, non è degli omosessuali del vero popolo brasiliano, tranne quando fanno di loro la gioia degli omosessuali del vero popolo indiano. Il punto qui è che i conservatori in India hanno anche cercato di renderlo brutto essere un uomo eterosessuale e hanno finito per renderlo bello essere una persona omosessuale.

Iniziamo con la descrizione di "Moment" di Twitter Brasil[03] (quella del corrispondente inglese è un po' troppo breve):

L'omosessualità cessa di essere crimine in India

Con una decisione unanime, la Corte Suprema del paese ribaltò una legge del 1861 che puniva atti "contro natura" e penalizzava fino a 10 anni di carcere le relazioni tra persone dello stesso sesso. Quella legge era già stata rovesciata da una corte di Nuova Delhi, ma la sentenza è stata annullata nel 2013 dalla stessa Corte Suprema, che ha definito che la sentenza sarebbe stata approvata dal parlamento. Poiché il legislatore non ha raggiunto un accordo, il governo indiano ha chiesto ancora una volta alla Corte Suprema di pronunciarsi.

Così, io sono andata a fare una rapida ricerca su cosa sia, legalmente, essere un uomo etero in India.

1) La prostituzione in India non è illegale, ma è illegale mantenere o gestire un bordello, un hotel consentire la prostituzione e persino offrire o sollecitare il servizio entro 200 metri da un luogo pubblico.[04]

2) C'è già una campagna in India dal titolo "Uomini Cool Non Comprano Sesso", da Apne Aap, una rete di donne che dice che sta combattendo per "porre fine al traffico sessuale"[05]. Ma come dicevo, proibire la prostituzione per porre fine al traffico sessuale è come mettere fuorilegge il matrimonio per porre fine alla violenza domestica. E loro dicono che "senza la richiesta di sesso comprato, trafficanti, sfruttatori e proprietari di bordelli verrebbe messo fuori mercato"[06].

3) La vendita, la circolazione, l'importazione, l'esportazione, la pubblicità, ecc. di materiale osceno danno almeno 2 anni di reclusione più multa (sezione 292 del Codice Penale Indiano).[07] Atti e canzoni osceni danno almeno 3 mesi di prigione, multa o entrambi (sezione 294).[08]

4) Un uomo che vede o fotografa, in modo nascosto, una donna nuda o in biancheria intima, o che diffonde una foto quando lei acconsente all'atto ma non con la divulgazione, questo è un crimine chiamato Voyeurismo, con punizione di almeno 1 anno in carcere (sezione 354C).[09]

5) Lo stupro nella legge indiana è lo stupro vero e proprio, non la clowneria qui in Brasile, che toccare una donna sull'autobus è stupro o addirittura la "sestorsione" via internet trasformandosi in stupro virtuale[10]. Ma là, include anche il caso di un uomo che finge di essere il marito della donna. Ma allo stesso modo che in Brasile fino a circa 10 anni fa, il Codice Penale Indiano prevede solo lo stupro di una donna da un uomo. E il limite di età del presunto stupro che in Brasile è 14 anni, là è 18 anni. A meno che l'uomo e la donna siano sposati e lei abbia almeno 15 anni (sezione 375).[11] Prigione per almeno 20 anni, che può essere perpetua o pena di morte (sezione 376).[12] Se io dovessi aspettare fino a 18 anni, io diventerei pazza. E a tutti i ragazzi che mi mancherebbero la possibilità di... incontrare dalle 14 alle 18, e dei bei momenti che ho dato e ricevuto, avremmo perso. E la cosa più drammatica per me sarebbe io che voglio essere scopata ei ragazzi hanno paura di scoparmi. Ma la cosa peggiore è che, in pratica, questo significa proibire la vita sessuale non delle donne, ma degli uomini sotto i 18 anni, dal momento che non dovrebbe essere comune una donna interessarsi a uomini più giovani lì, allo stesso modo che non è qui. E un uomo adolescente non avere aspettative di vita sessuale è una terribile sofferenza.

6) Ah, e non c'è donna adultera nella legge indiana.[13] La sezione 497 del Codice Penale Indiano definisce l'adulterio come "rapporto sessuale con una persona che è e che lui sa o ha motivo di credere che è la moglie di un altro uomo".[14] Pertanto, l'adulterio ha una sola persona, l'uomo che ha fatto sesso con la moglie di un altro uomo. Minimo 5 anni di reclusione, multa o entrambi. La donna sposata non è inquadrata in nulla. Oh veramente.

Gli omosessuali in India sono stati liberati dalla reclusione per almeno 10 anni più multa potendo raggiungere l'ergastolo, per il sesso omosessuale (non perché sono omosessuali, come hanno detto alcuni idioti in Brasile).[15] Anche io sono felice per i gay lì (non per le lesbiche, perché, come abbiamo visto in Brasile, il lesbismo non è sessualità, è psicopatia). Ma lì, gli uomini eterosessuali non avevano una libertà sessuale che gli omosessuali hanno ora guadagnato. Ad esempio, le molestie sessuali possono essere commesse solo da uomini, e un uomo che mostra pornografia a una donna può arrivare fino a tre anni di prigione, multa o entrambi (sezione 354A).[16]

E guarda, io ho pensato di menzionare Apne Aap (di quella campagna contro i clienti della prostituzione) solo di passaggio, torno alla pagina e vedo nella barra laterale il post più recente sul loro Twitter[17]:

"Io sono quello che sono. Quindi, prendimi come sono". - CJI @apneaap accoglie con favore il giudizio storico dell'onorevole Corte Suprema dell'India che abbatte la sezione draconiana 377. Un altro passo avanti verso #l'uguaglianza #nonpiùarmadi #l'amorevince

Quindi, il sesso eterosessuale è un crimine e il sesso omosessuale è amore? Oh, che sorpresa!
